Terms of Service

1. Acceptance of Terms

By accessing or using Rent Verified ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. Rent Verified reserves the right to update these terms at any time. Continued use of the Service after changes constitutes acceptance.

2. Description of Service

Rent Verified is a platform that allows users to search for rental properties and read or write reviews about their rental experiences. The Service is provided free of charge to renters and is accessible via web browser.

3. User Accounts

To write reviews, you must create an account with a valid email address and phone number. You are responsible for maintaining the confidentiality of your account credentials. You must be at least 18 years old to create an account. You agree to provide accurate, current, and complete information during registration.

4. User Content

By submitting a review, comment, photo, or other content ("User Content"), you grant Rent Verified a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute your content in connection with the Service. You retain ownership of your content.

You agree that your User Content:

  • Is truthful and based on your genuine experience
  • Does not contain false, misleading, or defamatory statements
  • Does not contain hate speech, threats, harassment, or discriminatory language
  • Does not violate the privacy rights of others
  • Does not contain spam, advertising, or promotional material
  • Does not infringe on any intellectual property rights

5. Review Guidelines

Reviews must be based on actual rental experiences. Rent Verified reserves the right to remove reviews that violate these terms, are flagged by multiple users, or appear to be fraudulent. Users may report reviews they believe violate these guidelines.

6. Prohibited Conduct

  • Creating multiple accounts to manipulate reviews
  • Posting reviews for properties you have not rented
  • Attempting to extort landlords or property managers
  • Using automated tools to submit content or scrape data
  • Interfering with the proper functioning of the Service
  • Impersonating another person or entity

7. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. Rent Verified does not guarantee the accuracy, completeness, or reliability of any user-submitted reviews or property information. You use the Service at your own risk.

8. Limitation of Liability

Rent Verified shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to reliance on reviews or property information.

9. Termination

Rent Verified may suspend or terminate your account at any time for violation of these terms. You may delete your account at any time by contacting us at Support@rent-verified.com.

10. Indemnification

You agree to indemnify, defend, and hold harmless Rent Verified LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) any User Content you submit, post, or transmit through the Service; (c) your violation of these Terms; or (d) your violation of any rights of another party.

11. Fair Housing Compliance

Rent Verified is committed to compliance with the Fair Housing Act (42 U.S.C. § 3604) and applicable state fair housing laws. Users shall not post content that discriminates or encourages discrimination based on race, color, religion, sex, familial status, national origin, disability, or any other characteristic protected by applicable law. Rent Verified reserves the right to remove any content that violates fair housing laws and to terminate the accounts of users who engage in discriminatory conduct.

12. Copyright / DMCA Policy

Rent Verified respects the intellectual property rights of others. If you believe that content on our platform infringes your copyright, please refer to our DMCA Policy for instructions on how to submit a takedown notice. You may also contact our designated DMCA agent at dmca@rent-verified.com. Users who submit content warrant that they own or have the right to use all content (including photos) they upload to the Service.

13. Anti-Retaliation

Landlords and property managers who use the Service agree not to retaliate against any tenant for posting a review on Rent Verified. Retaliation includes, but is not limited to, threatening eviction, raising rent, decreasing services, or refusing to renew a lease because a tenant posted a review. Violations of this provision may result in account termination. Note: Florida Statute § 83.64 independently prohibits landlord retaliation against tenants who exercise their legal rights.

14. Dispute Resolution & Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court. You and Rent Verified agree that any arbitration will be conducted on an individual basis and not as a class, consolidated, or representative action.

Class Action Waiver: You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against Rent Verified. If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void.

Small Claims Exception: Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.

15. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. For any disputes not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Hillsborough County, Florida.

16. Force Majeure

Rent Verified shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from any cause beyond its reasonable control, including but not limited to: acts of God, natural disasters, pandemic, government actions, internet or telecommunications failures, power outages, or cyberattacks.

17. Changes to Terms

Rent Verified reserves the right to modify these Terms at any time. For material changes, we will provide at least 30 days' notice by posting the updated Terms on this page and, where possible, notifying you by email. Your continued use of the Service after the notice period constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, Community Guidelines, and DMCA Policy, constitute the entire agreement between you and Rent Verified regarding the use of the Service.
